Judge Sonia Sotomayor Supreme Court Nominee

So this morning while making breakfast I had the TV on and watching Meet the Press (NBC). The subject today was Judge Sonia Sotomayor and some of the comments she has made and some of the rulings she has made.

Judge Sonia Sotomayor is a Latino woman. She has a impressive resume but its some of her rulings and some of the remarks that have been made that have some wondering if she is not using reverse discrimination.

She wrote the 2008 opinion supporting the City of New Haven's decision to throw out the results of a firefighter promotion exam because almost no minorities qualified for promotions. The Supreme Court heard the case in April 2009 and a final opinion is pending.

However what has caught more attention is a speach she made in 2001 (as printed here):

• At a 2001 U.C. Berkeley symposium marking the 40th anniversary of the first Latino named to the federal district court, Sotomayor said that the gender and ethnicity of judges does and should affect their judicial decision-making. From her speech:

"I wonder whether by ignoring our differences as women or men of color we do a disservice both to the law and society....

"I further accept that our experiences as women and people of color affect our decisions. The aspiration to impartiality is just that - it's an aspiration because it denies the fact that we are by our experiences making different choices than others....

"Our gender and national origins may and will make a difference in our judging. Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am also not so sure that I agree with the statement. First, as Professor [Martha] Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experience would more often than not reach a better conclusion than a white male who hasn't lived that life." [U.C. Sotomayor said that the gender and ethnicity of judges does and should affect their judicial decision-making.

Woah really - I personally strongly disagree with this. I mean what happened to judging according to the case? I would think that race, sex and religion should be left out. Cases should be judged on their merit and not on your life experiences after all its not "your" life that is on trial. Judges need to be a neutral umpire in a trial.

Here is what was on "Meet the Press" this morning about the subject (its a little over 5 mn but worth the time to watch)

Note: remember this is a family friendly site and everyone is entitled to their opinions so lets not get heated towards each others views. Discussions are good but lets not turn this subject into a racial fight against each other.

To say that the gender and ethnicity should effect the judicial decision making is ignorant and purely embarrassing on behalf of the Latinos she represents. People of "color" work extremely hard to be able to sit in the potions that they earned. Whether or not they were granted that position because of their ethnicity is irrelevant. Most of the time it may or may not work to their advantage to gain that power. It's a 50/50 chance. They may have a foot in the door because of their ethnicity and in the same instance it can be their handicap. As a Latina myself, I have to say that at times you have to work ten times harder when you're a person of "color." So once you're in a judicial position, why would you make decisions that any other judge would make? Why would you let your ethnicity affect the decisions you make? If a Caucasian judge were to say the same thing...would they not feel the backlash of their words? Would Judge Sotomayor say it would be fair for a Caucasian judge to make decisions based on their ethnicity? I don't think so, I think that if she were Caucasian that is would have the reverse effect. We're in 2009....we have a black president...and we shouldn't be still talking about ethnicity or race. The more you talk about races, the quicker you're losing the battle for everyone.

WOW very well put Phoenix - very well put. I agree that race (same as sex and religion) should have no play and when you make it a play your only stepping back on time and making it worse. Its time to judge ppl on who they are regardless and move on. What is that one saying "can't we get along"

I more or less agree with Phoenix, the more you think about things in terms of race the worse off you're gonna be for it. That comment she made could be called racist, but still I'm not sold on her being a full blown hate-whitey rasicst. Her Judicial record should speak for itself, whatever it is, and the people compaining about there being pressure on her need to wise up because EVERY person who get nominated is scrutinized this way, so deal with it until its over then it will be like it never happened.

well I guess this is starting to heat up on if she should be let in or not:

I think she is a incredibly smart woman but I'm just not comfortable with her nomination. I dont think she is a full on as glover put it whitey hater but I do think she comes to the table as semi racist. She would not have my vote at this time.
